Categories: Crime

UPDATED @ 7:15pm, Monday with narrative from BSO arrest report:

BSO responded to a domestic violence in call in Broward County...

Upon arrival deputies met with victim who issued a sworn taped statement advising the following allegations.

Victim stated incident involved ex husband and current boyfriend, 1800 hours while they were attending a Heat game at AAA. She stated she did not want to hold Ruiz's hand b/c she was hot and her hand was sweaty.

She said Ruiz became angry with her and started calling her selfish bitch, bi-polar, lesbian, prostitute and whore.

She said she left AAA and Ruiz refused to drive her home.

She didn't have a cell phone to call anyone to pick her up.

She flags down a cab and tell cabbie to take her home to the city of ________.

She said that on the way home Ruiz used his vehicle to cut off the taxi cab.

She said he yelled obscenities from his vehicle.

Victim states she gets home, couldn't gain entry to property b/c Ruiz deactivated gate code.

She jumped over fence and makes contact w/ Ruiz's father.

Ruiz's father lives in separate home behind the Ruiz home.

She tells father of Ruiz she wants to get her stuff from the house. Then the Dad, makes contact w/ Ruiz.

Then Ruiz approaches her continue his verbal abuse.

She sits down on front step since she is denied entry into the home. She is now arguing with both dad and son.

She said Ruiz gets a semi-automatic gun from the trunk of a MDPD police car. She said he racked a round into the chamber, pointed the barrel to the ground and held it by his side. He then paces back and forth at times coming within 2 feet of her.

The offense set forth in the forgoing Affidavit is contrary to the statue in such case made and provided, and against the peace and dignity of the State of Florida.

Miami Dade police Sgt.
Reinaldo Ruiz
-from Local 10.com:
A Miami-Dade Police officer is under arrest on suspicion of aggravated assault and domestic violence charges.Broward Sheriff's Office deputies arrested Sgt. Reinaldo Ruiz, 47, on Friday in Southwest Ranches.

Ruiz is charged with two counts of domestic aggravated assault with a deadly weapon without intent and one count of battery
So far, Channel 10 is the only South Florida media outlet reporting the story. Not an important story in the grand scheme of things, but a story nonetheless about a police officer allegedly using a weapon in the commission of a crime.

Ruiz, who's been with the department for 27 years, has managed to keep his name out of the news until now.

He does show up in a 2006 Miami Herald story on overtime paid to Port of Miami police officers.
Miami-Dade County Police Officer Luciano ``Lucky'' Sanchez worked so much overtime at the Port of Miami-Dade in 2005 he nearly tripled his $60,000 base salary to $172,688, county records show. His colleague Frankie Buckner did even better, turning the same base salary into $180,212. Officer Reinaldo Ruiz managed to turn his $70,200 base salary into $181,561.
[...]
Sanchez, Ruiz, Buckner and many of the other officers at the port are within a year or two of eligibility for their public employee's pension - which is calculated based on the officers' best years of income.
And Ruiz shows up on the list I posted last Nov. of Miami-Dade county employees who make more than $100,000 a year.

QUESTIONS: Could the Martin County Sheriff's Office employ even more derilects than it does now?  What does this mean for the Martin County citizens.  Or any law abiding citizen?  What will you do when you are forced to pay for their future acts of misconduct?  What will you do when they misuse their authority on you or yours?  Will you do nothing as you have been doing?  Or will you just eat your losses by claiming that you can't fight city hall?  Did you know that you can vote any elected official out of office?  Why don't you start spreading the word today?

Could This Be Another Batch Of Lying Deputies?

In mid 2011 another “Archangels” female client learned that she had been improperly and illegally run on the DAVID (Drivers and Vehicles Identification Databank) in violation of the DPPA (Drivers Privacy and Protection Act).  Seventy-Nine St. Lucie County Sheriff’s Office deputies were just a few of the many from various sheriff’s offices who had been stalking her on the computers.  She immediately sent letters to the many departments and SLCSO Lieutenant Hostetler of the Internal Affairs Unit conducted an incomplete and bogus investigation into the matter.  Here are just four of the many, many, violations.  But you be the judge…….

Deputy Sean Freeman: Ran the victim 15 times and Hostetler’s report about all stated “no valid reason.”
(Note - The 5th and 6th times the victim was in the hospital giving birth.  There couldn't have been a valid reason, but Hostetler never checked)

Deputy Randy Tucker ran the victim 2 times and Hostetler’s report states that he was in training with a field training officer.  There is no indication that Hostetler even contacted the FTO.  Why is a trainee even running a deputy in the first place?   There is no indication of any disciplinary action being taken.
(Note – Those are the exact same dates as above where she was in the hospital.  There couldn't have been a valid reason, but Hostetler never checked)

Deputy Christopher Gordineer:  Ran the victim 21 times.

Note - 3-13-11 is the only one marked with a reason which states “BOLO (Be on the lookout) LEO “Law Enforcement Officer reasons.” “Archangels” has verified that there was no BOLO and that statement is absolutely false.  There is no indication if Hostetler even verified Gordineer’s statement.

Deputy Dennis Bernas: Ran victim on 7-18-06.

Note - Bernas made a false statement claiming he ran the victim in regards to an incident that had occurred several years after he ran her.  That false statement could have been easily disproven, but there is no indication that Hostetler even attempted to verify Bernas' statement.  Bernas was a Lieutenant on the SlCSO and the victim was still employed there at that time.

But wait there’s more!

In his report, Lieutenant Hostetler appears to have spent more time slandering the victim which had absolutely no bearing on her being illegally “stalked” on DAVID.  That was obviously done to justify the illegal and improper conduct of the deputies. ( “Archangels” has redacted that information from the attached exhibits)  He apparently did take some disciplinary actions against some of the deputies, however the fact that they lied during an Internal Affairs investigation was never investigated in order to apparently cover-up their criminal conduct.  By the way, lying during an IA investigation is a crime under Florida law punishable by prosecution and termination of employment.

QUESTIONS: Do you think that Lieutenant Hostetler’s investigation was thorough and complete?  Do you think that he is an expert in creating a cover-up?  Are you concerned that someone like him wears a badge?   Do you wonder what other criminal conduct of “Good Ole Boy” deputy friends he has covered-up?  And how many deputies that are not “Good Ole Boys” he has screwed out of their jobs and pensions?  Did you know that it takes a certain breed to do what people like him do?  Do the words dishonest, no conscience, and a waste of taxpayer money fit the bill?   Does it seem that there is a pattern beginning to be evident?  Let’s all work to get rid of people like this and replace them with honest and ethical public employees.  REMEMBER THAT WHEN YOU VOTE!

Are some of the Indian River County Sheriff’s Deputies liars?

In 2011, one of “Archangels’ female clients filed a complaint with the Indian River County Sheriff’s Office regarding her being stalked by various deputies on the DAVID (Drivers and Vehicle Information Databank) which is a violation of the Drivers Privacy and Protection Act.  “Archangels” had previously obtained information from the State of Florida that she had been illegally run through the computer system more than six hundred times and her husband had been  run two hundred times.  Not to mention her sisters being run another 200 hundred times.  The woman was requesting the reasons those deputies had been looking at her personal information.  For the record the woman had formerly been an IRCSO Deputy Sheriff and is extremely good looking having played the character “Snow White” at Disney World.

On July 20, 2011 IRCSO Lieutenant Darrell Mullinax authored reports related to interviews he had conducted with 4 of those deputies including: John Carter, David Wright, Scott Prouty & Jeff Ledlow.   They provided the attached answers which were documented by the Lieutenant (Attached).  In essence, those deputies claimed that they had been checking various vehicles by license number and one of the license numbers was hers.  That information was absolutely false.  State records obtained by “Archangels” (Attached) clearly show that those deputies actually ran her information using her name not her license plate number.  Furthermore, Lieutenant Mullinax never verified the information they provided which resulted in him covering-up of the truth.  For your information, the female former deputy has filed a lawsuit against those deputies and the IRCSO seeking statutory damages for the illegal searching of her personal information.

But now that those deputies, along with others, have lied they may have enjoined themselves in a punitive damages award.  That means, the taxpayers could be stuck paying not only the damages for the violations of the actual privacy act violations but the “punishment” because those deputies lied.  But, that is the only way to stop those intrusive acts by government officials.  When taxpayers are forced to pay the bill and become outraged those illegal acts will stop.

QUESTIONS:  Did David Wright leave IRCSO under a cloud for running a Brevard County woman he had met one time on Facebook?  Do you believe that IRSCO deputies are all honest.  Do you think that Lieutenant Mullinax did a fine job or should he be replaced by an honest responsible person who will seek the truth?  Or by a monkey?  Do you think that “Archangels” will provide more perjured reports soon?  Do you think they have more against IRCSO deputies and other sheriff’s offices?  YOU BETTER BELIEVE THEY DO!  More in the works.

Could This Be A Mistake?

In 2006 Martin County Sheriff William Snyder ran for Florida State Representitive against Cathrine Hilton. The news and literature at the time claimed that he was married with three children.  However, recently obtained documents from THE SUPERIOR COURT OF GUAM (that's right Guam) clearly show that Snyder and his wife were separated on or about June 13, 2004 and divorced March 3, 2005.

QUESTIONS: Could it be that Snyder, who claims to be a fine Christian man, did not want to disclose that he was not so fine as he represented?  Doesn't this show just how deceitful he really can be?  Why would he have to secretly divorce in Guam?  Did he think people would never find out about the when and where of his divorce?  Didn't he realize that "Archangels" would eventually bring it to light?  STAY TUNED?

Q. - How do you deal with elected officials who place their own interests ahead of the people they have sworn to protect?

The answer is simple. Use your brains, the information “Archangels” discloses, and then vote for someone else.  Choose people who are honest and ethical and don’t accept anything less.

It is so sad that in this day and age people are afraid of voicing their displeasure.  Especially, when it comes to criticizing a sheriff who surrounds himself with unethical or criminal “Good Ole Boys,” or a prosecutor who wrongfully prosecutes people, or a judge who is bought and paid for and uses his position to help his friends.  The expression “I love my country but fear my government” has become the rule rather than the exception.  People have become fearful of the repercussions they could face for speaking the truth.  But if enough people use their secret ballots to rid government of unethical and dishonest officials we can slowly force a change.

People have given their lives for us to live in freedom.  And “Archangels” will not give those rights away without a fight.  Please join us in asking all of your friends, associates, and relatives to read and forward Facebook/Archangels of Justice and irarobins.blogspot.com and all of the supporting evidence.  Then once you have seen the truth, do not vote for, or contribute one dime, to any candidate that you can’t trust.  You will then have made change without fear of retaliation.

Did you know that Internal Affairs, also known as the Professional Standards Unit, only investigate and punish officers who are not part of their “Good Ole Boy” network?

Their supposed only purpose is to discover the TRUTH about an incident/complaint involving an officer.  But they actually work to protect their Good Ole Boy” buddies and punish anyone who questions what they do.  It is absolutely wrong but exactly what takes place in these so-called internal investigations performed by the so-called professional standards unit.

“Archangels” has learned that some agencies actually place investigators with credibility issues in these IA units. These investigators have such a problem telling the truth that they are no longer allowed to testify in court. What? Can't testify in court, but they can conduct an internal affairs investigation?  Do you see the correlation there?  Truthfulness is not a requirement to investigate and cover-up an officer involved crime or act of misconduct or to punish someone who is innocent.

In one case that “Archangels” investigated in Indian River County there were four deputies that claimed under oath and in writing that they properly ran the license plate of one of our DAVID (Drivers and Vehicle Information Databank) case victims.  It would violate criminal and civil law and their own department rules to improperly enter that databanks.  They actually stated they must have been patrolling the Sheriff's Office parking lot and observed a suspicious car and ran the tag.  That's right, four different deputies, four separate occasions and the Lieutenant that took those statements was the same person.  Wow, what are the chances of that happening?

A written request to the Department of Highway Safety and Motor Vehicles proved that they actually ran the young lady by NAME and not license plate number. That means they LIED under oath.  When “Archangels” reported it to IA they didn't do a thing about it.  So ladies and gentlemen that means not only does the Professional Standards Unit condone lying they also lie themselves.  Sadly, the deputies that lied, along with the Lieutenant that allowed them to lie still work there.  And the State Attorney will use them as credible witnesses to prosecute you in court.  Isn't it comforting to know that there are deputies working in Indian River County that lie and that it is allowed?

Now let us make this clearer, the situation is much worse than just the four and not isolated to Indian River County.  “Archangels” found this to occur in a number of other police agencies, which we will discuss on a later date.

These four could have been caught in the lie by their own IA investigator, if he did his job correctly.  Remember, we said in the last post to verify and validate what people say, before accepting it as truth. So, what is it?  Does the investigator work for the good of the agency and community?  Or does he work for the liars and corrupt officials in the agency?  Does the Sheriff condone this behavior?  We must take into account that all of these Sheriffs are elected officials. They get elected by popularity, not necessarily by the job they actually do. The same goes for their subordinates, if they can get the boss re-elected, they get protected and advanced in rank.

The answer to this travesty is accountability and responsibility. If the agency cannot or will not be accountable then maybe there should be a citizen oversight committee put in place to make sure the rules are followed at all police agencies. The game playing, lies and favoritism must stop since the police apparently cannot be trusted to police themselves.

Many police officers complain of this conduct all of the time.  Many of them say that are sick and tired of the favoritism exhibited by their administrators.  They explain that the punishment meted out case by case is never the same for the same violation from officer to officer.  Even worse is the punishment or banishment of officers that blow the whistle on the wrongdoing.

The police culture is reminiscent of the old adage; see no evil, speak no evil, hear no evil.  It's sad that a police officer cannot speak out against wrongs being perpetrated by other officers or an administrator without fear of reprisal.  What good is the agency or the officer to the community when their own house is not clean regardless of who is committing misconduct? Politics be damned, there is NO Place for it in law enforcement or the courts.

“Archangels” has shown in past posts along with supporting documents the cases of injustice perpetrated on a few people on the Treasure Coast.  They are true stories not figments of our imaginations.  We have over 80 years of investigative experience between us and have no reason to lie or fabricate half-truths.  The challenge before us is to help you the citizens, the police officers and the agencies to self correct before it is too late.  Thank you for your continued support.

Is It Too Much Trouble To Demand Our Law Enforcement Agencies Obey The Law?

Many citizens have had their rights violated by government officials and could do nothing about it.  Many have suffered financially, lost their jobs, their reputations, and their freedoms.  All of them suffer from the continuing stresses of being unable to correct something they know is wrong.  But did you know that there are higher level commanders who delight  at what they have illegally done to others and even give each other a “high five” while laughing about it.  It happens every day!

Law enforcement officers should report violations of the following to their departmental supervisors or if they fear retaliation write anonymously to: Rastrelli Investigation 3110 SE Slater St., Stuart, FL 34997. There is no need to put return address or name on your information. Complete confidentiality.

Due process is a term that basically describes the systematic search for the truth in a court of law. In the attempt to protect the rights of an accused person to a fair and impartial trial, there are rules put in place. Once a person is accused of a crime an investigation commences; it includes taking statements from witnesses and victims. In order to do prevent contamination of the statements, they should be taken separately from one another, by keeping the parties apart. This way the statements are independent and not biased by another person.  Secondly, there is the collection of any and all physical evidence found at the scene of the crime that not only points to guilt but may also point towards the innocence of the potentially accused person.

Statements from each person should be taken orally as well as written  as people express themselves differently in speech from in written word. Most people ramble on when they talk and some of what they say is extraneous words that may or may not be important. Written statements tend to be less wordy and more concise, based on the person's education and writing skills.

Eyewitness accounts tend to be jaded and sometimes biased, based on the person's prejudices or beliefs. That is why eyewitness accounts MUST be verified. In other words could the person actually see what they said they saw?   Investigator MUST return to the scene and stand or sit where the eyewitness was when the observation was made. Not doing so leads to mistaken identity, or acts, which in turn can lead to unlawful arrests and convictions.

Collecting evidence isn't as simple as just picking something up and placing it into a bag or box. It first must be documented by camera then collected in such a way as to not contaminate the evidence. Some items can go in plastic bags or containers, while any biological evidence must be sealed in paper or cardboard to prevent contamination. Improper collection results in bad test results which negate the value of any physical evidence.

The next step in the process of the investigation is being certain that the witness or victim is not lying. This is the hardest part of all, since people lie all of the time in criminal cases. Sometimes it is done out of spite or revenge for some real or imagined slight. The background of the witness and victim should be scrutinized in detail, before trusting everything that comes from their mouth. It doesn't matter if you’re a prosecution or defense investigator, you must know the background of the victim and or witness.

Any evidence that proves to be exculpatory, that is tending to verify the innocence of the accused, must be disclosed.  Many times police or prosecutors in a hurry for a conviction, overlook the very evidence that may prove innocence rather than guilt. Thus we have a situation where a person is wrongfully arrested and convicted.  If you don't think it happens, you better think again.  By investigators omitting evidence or statements they can actually stack the deck against the accused, and set them up for a conviction.

As we move forward into the courtroom the judge is in charge of the protection of the evidence and testimony presented in the courtroom.  The judge is to be completely neutral to the case, and to provide the most sterile environment for the trial to unfold in.

Then we have the jury, all of them laymen, with no experience in courtroom etiquette or law for the most part. They are to weigh the evidence presented to them and then decide the fate of the accused as to guilt or innocence.

Enter the backroom antics of local politics, luncheons, golf tournaments, dinners, parties, boating and other social gatherings and you now have what is referred to as the good old boy network.  It doesn't matter what part of the United States you’re living in, it exists.  If you are not part of it, or ostracized from it, you can easily find yourself convicted in court by a the unscrupulous conduct on the part of the judge and prosecutor.

There are times in court where special witnesses, called experts are barred from testifying since their statements may induce doubt in the mind of the jurors. Why is this allowed?  Any witness  by virtue of their proven experience related to seeking the truth can help free an innocent person and should always be welcome in a courtroom. The other witness judge’s bar from the courtroom are ones that have newly discovered evidence.  Again why?  If the person has evidence that proves innocence then they also should be welcome in court.

Then there are the favorites, judges, lawyers, cops and others that have a league of their own that maintain a certain status quo,  that protects their dynasty. If you are not part of this elite group you run the risk of being railroaded into a prison cell.

Archaic, outrageous, barbaric, biased, prejudice, you name it, it's wrong but it happens every day in a courtroom here in the good old USA.  How do we stop it?  Who holds these people accountable to maintain the integrity of the criminal justice system?  We do, the American taxpaying public.  If we don't, we all become victims of the very machine that is supposed to protect us.

Make no mistake about it, whether it's divorce court or criminal court, there are billions of dollars poured into the pockets of lawyers all over the USA. The judges can keep the door swinging, by allowing their favorite attorneys to win or by granting multiple continuances to wear down the accused mentally, physically and financially. {Favorite attorneys; biggest donations, lavish parties, outings, trips, vacations you name it}
